Mexican civil records and the federal translation rule

The U.S. Department of State’s civil documents page for Mexico names the state civil registry (registro civil) as the issuing authority for birth, marriage and divorce certificates.

Whichever side of the border a record comes from, 8 CFR 103.2(b)(3) applies to anything filed with USCIS: a document containing foreign language must be accompanied by a full English language translation that the translator has certified as complete and accurate, and by the translator’s certification that he or she is competent to translate from the foreign language into English.

That means the whole acta is translated, including marginal annotations, stamps and registry numbers. Our certificate of accuracy states completeness, accuracy and translator competence. Acceptance is decided by the agency reviewing your file.

  • Acta de nacimiento. Mexico moved to a standard green format in 2016. The State Department notes that all birth certificates in previous formats continue to be valid, and that certified copies are available from civil registry offices or online at gob.mx/actas.
  • Acta de matrimonio. Issued by the civil registry. Certified copies are available.
  • Acta de divorcio. Issued by the civil registry. The State Department adds that marriage certificates with an annotation noting divorce are obtainable in some states and are also acceptable proof that a marriage ended.

Translations and interpreters in El Paso courts

The Western District of Texas says it appoints spoken-language interpreters in proceedings instituted by the United States. In all other proceedings, the court’s interpreter page says it is up to the parties to contract and compensate interpreters. The district reports 13 federally certified staff interpreters across its divisions.

For written evidence in Texas state courts, Rule of Evidence 1009 makes a translation of a foreign language document admissible when the proponent serves it on all parties at least 45 days before trial together with the foreign language original and a qualified translator’s affidavit or unsworn declaration giving the translator’s qualifications and certifying accuracy. A translator’s live testimony or deposition is the alternative, and the court can adjust the deadlines for good cause.

The Texas Office of Court Administration draws the line this way: interpreters work in spoken and signed languages, while translators work in written languages. We provide written translation only.

School records: UTEP and EPCC

UTEP’s undergraduate catalog says all transcripts in languages other than English must be accompanied by certified English translations by the educational institution, an American Consulate, or a certified English translator.

El Paso Community College’s transfer credit page says foreign transcripts must be provided by the student in English and that students must supply credit recommendations from a credentials evaluation agency. Ask the agency you choose whether it has its own translation requirements.

Getting a Texas apostille when you live in El Paso

An apostille is for a Texas document going abroad, for example an El Paso County birth or marriage record being presented in Mexico. Only the Texas Secretary of State issues it. Send Form 2102 with $15 per document to the Authentications Unit, 400 West 15th Street, Austin, TX 78701. The Secretary of State says to allow up to two weeks from the day of receipt for mailed requests, and in-person service is offered at the same Austin address.

If a translation is part of the packet, the state requires a notary to witness the translator sign the translation, and the notarized translation has to include the source document or a copy of it. Certified records older than five years are not eligible. The state will not apostille federal documents or documents from other states or countries, so a Mexican acta is authenticated in Mexico, not in Austin. We can notarize the translator’s statement and help you assemble the request.
